my cars title is being held by bank i did a loan with and they only gave me a copy of the title will a copy work at the dmv?
A: http://www.sos.state.il.us/services/new_residents.html
Go there and check the various links for transferring your registration and drivers license to IL.
I just moved to Illinois. How do I get a driver’s license and Illinois license plates?
As a new Illinois resident, you may continue to drive on your valid out-of-state driver’s license for 90 days. CDL holders must obtain an Illinois CDL within 30 days of becoming an Illinois resident.
To obtain a new driver’s license, you must visit a Driver Services facility to surrender your out-of-state license and pass a vision screening, written exam and possibly a drive exam. Proper identification must be presented so we can verify your full name, date of birth, social security number, Illinois residency and written signature. Find the Documents you’ll need to apply.
You must change your vehicle registration and order new license plates within 30 days by filling out a form at a Driver Services facility.
Find out what you need to bring with you before you go by checking out the Facility Checklist.
Q: Illinois infant car seat question…?
I was just wondering if it’s legal in the state of Illinois to put an infant in a car seat in a pick up truck. There’s no back seat, and the way I always understood the law, babies have to be in the back seat…anyone know the specifics on this? I find it hard to believe that a state could outlaw infant car seats in trucks, because what about the new families who only have one vehicle (and it’s a truck)?
A: ummm……buy a car with a back seat.
Q: Can I back out of a car loan?
After signing for a car loan on a new car, I realized the dealer had added $1,930.00 in fees to the loan balance. Needless to say, he did everything he could to distract me and cover up the fees while he hurried to get the paper signed. I called him 24 hours later and asked if we could just void out the loan and I would immediately pay the full amount in cash. He refused to void out the loan and said yes I could pay it off, but would still owe the fees. Doesn’t one have a certain amount of time (such as 3 days) to rescind a contract? Also, could this be classified as a UNILATERAL MISTAKE” when one did not fully understand the terms of the contract? When I made the phone call to the dealer, I recorded the conversation and advised him I was doing so as proof that I made an attempt to rescind 24 hours later. The dealer is in Oak Lawn, Illinois.
A: i do believe you can get out of it,regardless of what he says about it,there is a certain amount of time for doing this and if you have proof that you called him id say you can get out of it,i hate it when they add that extra crap on to a deal,i got out of one,for the same thing, its ok if they get a little mad at you over it,they soon get over it ,and you,ll ,be better off but id sure give it a try,you don’t have nothing at all to loose from doing this, good luck on this one i hope it works out for you.
Q: I need to learn all i can about a repo in Illinois, what happens if I can’t make a car payment?
I have a new car which I purchased while I had a Good job with the state, but the governor cut the budget to my program and i was laid off. I am not behind on any of my car payments but it is getting harder and harder to make it. I have informed my loan co (americredit) about my lay off but i need to be informed as to what happens…do they take my car if i miss one payment? Do I have to be behind before they will even discuss options with me ?? and on their website i saw something about a 1099-C, what is that too? With the depression we are in it’s getting so hard to even put food on the table ..i need all the info anyone can give me and please …I’m not a deadbeat so please be kind.
so the 1099-C is what is left in the difference between what they would sell my car for and i would have to report that as income..would i still have to pay that amount to the finance co too or is it an either or type????
A: Yes they can take the car. It is smarter for you to drive it to Americredit and hand them the keys. Take a photo of the car at their office with the newspaper in the photo so you can document the return.
In theory you would owe the shortfall shown on the 1099..
Q: I just found out I am being permanently laid off and I own a new car just purchased in December, RE PO???
I am a 56 year old woman, getting permanently laid off due to buget cuts in Illinois state. I went bankrupt 3 years ago and cleared out everything..home and all..is it possible to go bankrupt again if I go for the restructering type and if not what will happen if they repossess my car…I know they will make me responsible for the unpaid which will be alot but can they take my home?? Jobs are very hard to find in the small rural community I live in and I am not able to move. I am either going to have to restructure or loose the car..the house payment is small so I can easily handle it but the car is going to be impossible…what happens to me and/or my home if I can’t pay what they say on the reposession? Will I be able to make small payments till I die or will I be homeless…and please don’t be rude in your answers…I’m just an old lady who needs to know. I’m not in the best of health and I am scared to dealth I will loose my home becasue of this possible reposession. HELP!!
A: First Don’t panic!
Sell the car, you will be responsible for the difference between what the car sells for an what you own on it. But that will be much less that if it is repossessed. If the car is repossessed it will be sold at auction for MUCH LESS than you can sell it for and you will still owe the difference (which will be much more). Keep out $1000 and buy a car for cash that will get you places for the next 2-3 years. After you sell the car, call the finance company, explain your situation, and tell them that you need to work out a repayment plan. Make sure that you can live with the repayment plan payment. Don’t let them bully you into agreeing to pay more each month than you can afford. As long as you keep up your house payments, your house will be fine.
In the mean time, if you cannot find a full time job. Look for several part time jobs. It is time to go into survival mode: babysit children after school, be a personal assistant and run errands for people, start a housecleaning business. It doesn’t matter what the work is because all legal work is honorable.
Q: re-titling a car in illinois?
I am buying an old car from a friend. He lost the original title, so how do I go about getting a new title in my name? I know he can get a duplicate and then it can be transfered to me, but i was wondering if there was a cheaper way
A: Don’t buy the old car from a friend, if he doesn’t ahve a title to turn over to you.
The CHEAPEST way, is for him to buy a duplicate, and then sign it over to you. The OTHER way, is for you to buy a title bond, and a bonded title – which will cost HUNDREDS more, and take up to six months to clear, so you can title it.
Q: Should I register my car before selling?
I have moved to Illinois and my car has expired plates and registration. Am I going to lose money in resale if I do not get new plates and registration first?
A: I am a motor vehicle agent for the state of NM and here I would very much not recommend re registering you car or registering it first time if you are going to sell it. That is only wasting your money, the registration you purchase cannot transfer over to the new owner?! They have to purchase their own in this state. So you might as well sell it not registered and let them pay for their own registration. In our state you can purchase a permanent sticker for travel trailers and utility trailers that weigh less than 6000 lbs and those are the only registrations that transfer over to new owners and would increase incentive for resale! Hope this helps but I would also check with your local state motor vehicle dept to check also. But I think that is kind of a universal rule.
Q: Buying a car and getting an apartment on little and so-so credit.. help?
I live in Arizona right now. In March I plan to move back home to Illinois. My only credit I have right now is a Capital One Card and it has a $300 limit. I’ve been late on the payment once, and went over 2 maybe 3 times so I know my credit isnt great. Between now and the time i move back I plan on getting a dept store card, and get some other stuff in my name to build credit. I dont know how fast credit builds up tho. before i move in march i wanted to get a new car. my current car is paid off, yet not in my name. Would it be difficult to get a new car if i traded mine in and get an apt of my own when I move back to Illinois? What can i do between now and March to prepare myself for life on my own in Illinois? I live at home w/ my dad now, so ive never had my own rent before.
A: Pulling a credit report for renting is only common in large communities. I assume you are fairly young so not having an excellent credit score will only result in a higher security deposit, and less likely slightly higher rent.
You will be able to get an auto-loan especially if you have a trade in. Your interest rate on the auto loan will likely be around 10-12%. Having it in your name will help build your credit so long as you make consitant timely payments.
Payments recieved within 30 days of the due date often never make it onto your credit report. Prior overlimits also will not damage your credit report like you may think, espeically if you promptly paid off the excess balance.
With a limited credit history it is very important to have as few red marks as possible. More importantly learning to pay off your balance in full, or atleast make the minimum payments monthly will be the keep to impoving your situation over time.
Q: What is the “Conditional Gift Rule/ Law” Does it apply in Illinois? Gift Car stolen 4 yrs later?
A car was given to me 5 yrs ago. I drive it 7-9 hrs every day. It’s my only means to get to dr’s for my heart monitoring and to keep watch of my mom / hospital. I am an organizer for youth and senior events around town and @ my church.
I am responsible for a lot of people who are elderly and cannot drive themselves, like my aunt who needed to have eye surgery that same week.
All of my 8 years of work in my presentation book, and several items were in the car. The HEATHEN even stole my personal bible (name engraved) which was in the front passenger seat. My Handicap plaquard and my cell phone charger.
This shut down my community events business completely. People were waiting and calling for the event that I had set up weeks ago & for that same day, the roten person got into my file and even had my cell phone turned off. In a few days, I was able to get to phone company and correct that with then another block and new code.
I was stranded in my house, with no food, no heart medicine and no way to call ambulance. I was very ill with rapid heart beats and needed to get / call my doctor and or paramedics. To this day, my car has not been returned, although there have been a few “Na Na Na” calls. It has been very difficult getting around town with MS.
The person also ripped my mink coat, shoulder to sleeve 3 yrs prior.
There had been no dissaggreement nor commuication of any kind for months nor any signs of annimosity what so ever, of this person. Just a 60 year old mischievous theif in the night.
I want to bring/press charges of Malicious intent and whatever else applies. Can you help? Thanks
A: It is hard to understand your question. In Illinois a vehicle is owned by the persons on the title.
Q: Can I drive more than one person to school in Illinois?
In Illinois, new drivers are only allowed up to one person (under age 21) in the car with them, except close family, for the first year.
Is there an exception to this rule that pertains to carpooling to school?
If you live in another state, I would appreciate your laws as well.
Thanks.
A: Many states have similar laws (I’m in MN, and we have one like this). There is no exception.
But, if one of the people are old enough to have more than one person, and they have their driver’s license, give them the keys and let them drive. Otherwise, just getting pulled over for a burned out tail light can you you in trouble for having more than one person in the car.
Q: buying a financed car out of state?
I’m living in Illinois, I’m going to New Jersey to buy a car from someone I met online with good specs and good price and low mileage. What documents do I need him to sign. He told me that I need to pay him with a check (when I go there).
He told me that he’s financing the car and needs to pay the loan to get the title.
What should I do? advice? any particular form I need to take with me before going to him?
A: It’s his responsibility to pay off the loan before he sells you the car. Don’t give him anything unless he has the title.
OR:
The easiest approach is to contact the lender yourself and inquire about the process. It’s a routine process for them, and they can guide you though the steps you need to take. It’s also a good idea to check out the title and vehicle registration requirements on your state’s department of motor vehicles Web site.
Q: New Insurance Law in Illinois?
Can anyone tell me what is the penalty for driving without insurance in Illinois and getting into an accident. I was driving my friend’s car and got into an accident, it was my fault because i was changing lanes. I have already paid the other guy for his damages and have gotten a release from him. This is a first time offense, what will happen to me.
What if it is not me who owns the car. It’s my friend’s car and he’s putting it away for the winter. I was driving it to the storage area when i got into the accident.
A: The fine could be $500 without insurance, and you will still be forced to obtain SR22 insurance. Get the insurance on your own, so the fine will be less.

Q: can there be two different auto insurances on the same car?
Im a new driver, im 17 and im in the state of illinois. I dont have a license yet, just a permit. My parents only have one car and i cannot afford my own at this time. My parents have allstate and their rates are too high for me. So i contacted another insurance agency and their rates for liability were lower. So, can one car be insured with two different insurances?
A: I work insurance claims and have seen instances when a car is dual insured, if there is a claim then it MUST be reported to both insurance companies and both companies will split the cost of the claim and if you’re at fault, then the rates will go up on both policies.
Why aren’t your parents working with you on this? Why don’t you guys go to an insurance broker who can find the most affordable insurance for your family needs? Your family may need to switch from Allstate to something else. You could help with the rates. If you drive your parents car you would be simpley added to the policy, you would not be charged a separate premium but the premium of the household would go up because of an additional driver, especially because your a new driver. So , for example , if your parents insurance was $90 a month, but you are added and it is now $120 a month, just pay your parents $30 to make up for the difference. That would be the most affordable way to go.
Q: How to put a lien on a car thats registered in a different state? How much does it cost?
in new jersey, vehicles are registered in – louisiana, florida, new york, georgia, and illinois.. i also need to know how much it costs to do so, and what paperwork is needed, and where i can get it.
Thanks!
A: In order to register your vehicle in another state, you must be able to provide proof of residence in the state that you are trying to register in. Each state has a different definition of residency. Some states will let you slide if you have a PO Box, but most require an address where the car will be garaged (home or office).
Q: My car did something funny when it started…
I’m from Illinois, visiting New Mexico and my car has been sitting in the driveway for the past two or three days. I haven’t needed it for the past two or three days, but when I started it today, it made a loud, low noise (like brrm-brrm-brrm — not grinding) and the car was shaking in time with the noise. I turned it off and started it again and the same thing happened. I let it run and after about 20 seconds of this, it seemed to be running normally. Is there something horribly wrong with my car, or is this just a product of sitting in the hot sun for a few days without running? I’m heading home tomorrow (hundreds of miles), so I need to be sure my car is working properly…should I take it somewhere to be looked at?
A: I live in Texas and my car does that some time for some reason the heat messes up the idle. after it runs a while and once you start driving it should stop if it does it when your driving get it checked but if it is olny when its sitting still it will be fine.
